In a move to safeguard public health, a federal court has taken action against a Louisiana-based food manufacturer for violating the Federal Food, Drug, and Cosmetic Act (FDCA). The case highlights the importance of food safety regulations and the government's commitment to holding companies accountable for producing adulterated products.

Listeria Contamination and Unsanitary Conditions Uncovered
The legal proceedings stem from a civil complaint filed by the United States government against Freshy Foods, LLC, Team Fresh & Go, LLC, and their owners, Floyd D. James and Ida M. James. The complaint alleges that the defendants' food processing facility in Elmwood, Louisiana, was manufacturing and distributing ready-to-eat food products, including sandwiches and fruit cups, that were adulterated and posed a threat to public health.According to the complaint, environmental tests conducted in 2023 detected the presence of Listeria monocytogenes (L. mono), a pathogen that can cause the serious illness listeriosis, within the defendants' facility. Additionally, a 2023 inspection by the U.S. Food and Drug Administration (FDA) uncovered unsanitary conditions at the facility, further raising concerns about the safety of the products being produced.
Voluntary Withdrawal of FDA Registration Raises Alarm
The complaint also revealed that the defendants had voluntarily withdrawn their registration to process FDA-regulated food products in August 2023, a move that further underscored the gravity of the situation. This voluntary withdrawal suggests that the defendants themselves recognized the need to address the issues at their facility and the potential risks associated with their operations.

The FDA has also emphasized its role in ensuring food safety and holding companies responsible for their actions. Deputy Commissioner Jim Jones for Human Foods at the FDA stated, "The FDA will continue to stress that it's the responsibility of food manufacturers to ensure they are producing food under safe and sanitary conditions. When a company consistently fails to demonstrate that they are capable of upholding their legal responsibilities, the FDA will seek to hold them accountable."
The Settlement and Consent Decree
Despite the defendants' initial denial of the government's allegations, they ultimately agreed to settle the case by entering into a consent decree.
